Terms and Conditions Artistic Hardware adheres to Australian Consumer Law (ACL) and the Consumer Guarantees covered by these Laws.
Goods supplied by Artistic Hardware will be;
Fit for the purpose for which those Goods are commonly supplied.
Safe, Durable and Free from Defects.
Acceptable in Appearance and Finish. Finishes shall be in accordance with the descriptions defined under “Finishes”.
All Faults present in a Product will be indicated at the time of Sale.
Our Product will match the quality of samples and demonstration models to be found at our Showroom Display.
Our Products will be “reasonably fit for any purpose” as specified by the Customer at time of purchase and agreed by Artistic Hardware as being suitable for that purpose.
Repairs and Spare Parts will be available for a reasonable amount of time.
Conditions of Sale
All Orders are to be paid for in full prior to despatch.
All Prices are inclusive of GST.
All Prices, Products and Specifications are subject to change, update or variation at any time without notice to the customer.
Artistic Hardware reserves the right to cancel an order at any time.
Where a failure of a Condition of Supply occurs, Artistic Hardware will provide a one of the following Remedies;
Repair – For minor problems, Artistic Hardware will repair the Faulty Product within a reasonable time. Replacement – Replacement Items will be Identical Items to that which is being returned to Artistic Hardware or with an Item which is of similar value. Refund or Credit Notes – A request for a Refund or for a Credit Note in circumstances which are outside of a those which can be defined as being a “Failure of Condition of Supply” will be at the discretion of Artistic Hardware. A Re-Stocking Fee maybe applied in accordance with any costs incurred by Artistic Hardware.
The following are not considered to be failures of the Conditions of Supply and do not constitute grounds for remedy or grounds to return a product to Artistic Hardware;
The Buyer has changed their mind and simply no longer wants a product.
The Buyer has ordered the wrong product.
The Buyer found the product cheaper elsewhere.
The Buyer found a better product elsewhere.
The Buyer was aware of relevant fault before buying the product.
The Buyer damaged the Product.
The Product has been used for a long time and the problem is the result of “wear and tear”.
Conditions for Return of Goods
When Returning Goods to Artistic Hardware, the Buyer must provide a copy of the Receipt for those goods being Returned.
Goods must be Returned within 14 days from the Date of Despatch.
Costs incurred by Artistic Hardware will be deducted from any Credit Note.
Artistic Hardware will pay for the necessary Shipping Costs involved in the return of Faulty Goods and will endeavour to pick up Faulty Goods from the Buyer within a reasonable amount of time.
Goods will not be accepted for Return for the following reasons;
The Product has been damaged and cannot be re-sold as a “New” article.
The Product is missing its original packaging.
The Product has been fitted.
The Product is missing components and fixings.
The Product is a “Made to Order item”.
The Product has been ordered especially for the Client and is not normally an item Stocked by Artistic Hardware.
The Product has been modified specifically at the Client’s request.
Stock Levels & Delivery Unfortunately, some items may not be “In Stock” at the time of ordering. If this happens to be the case, we will contact you immediately and discuss the likely Delivery Date. For items which are “Made to Order”, you will be contacted to discuss a likely Delivery Date, prior to the processing of any Payment. Payment will constitute a formal acceptance of the Terms of Supply. Delivery of the Goods will be made to the Buyer’s nominated address or carrier. The Buyer shall make necessary arrangements to take delivery of the Goods in person.
